Terms of service

1. Who we are
CBAM Exporter Pack ("the service") is provided by Hari Krishnan, a sole proprietor trading as FiveNine Cloud, Bengaluru, Karnataka 560048, India ("we", "us"). By using the service or creating an account you ("the customer") agree to these terms. If you use the service for a company, you confirm you may bind that company.
2. What the service does
The service helps you prepare CBAM emissions data from your own records: it reads documents you upload, applies EU calculation methods and produces reports, draft monitoring plans and evidence packs. It does not verify emissions, file declarations or act as your adviser. Read the disclaimer, which forms part of these terms.
3. Your responsibilities
- You are responsible for the accuracy and completeness of the records you upload and the values you accept.
- You must have an accredited verifier check any figures before they are given to an EU declarant as actual data.
- You must only upload documents you are entitled to share, and must not upload unlawful or malicious files.
- You must keep your login details confidential and tell us promptly of any unauthorised use.
4. Fees and payment
Prices are shown on the website or agreed in writing before purchase. Fees are payable in advance through our payment provider. Unless stated otherwise, fees for a report or period already generated are not refundable. If a paid feature fails for a reason within our control and we cannot fix it within 14 days, we will refund the fee for that feature on request. Subscriptions, if offered, can be cancelled at any time from your account and end at the close of the paid period.
5. Your data
You keep all rights in the documents and data you upload. You allow us to store and process them only to provide the service, as described in our privacy policy. You can export your outputs and ask us to delete your account and files at any time.
6. Availability and changes
We aim to keep the service available but do not guarantee uninterrupted operation. EU CBAM rules change; we update default values and methods when official texts change but cannot guarantee that every change is reflected immediately. We may change these terms by posting a new version and, for material changes, emailing account holders at least 14 days in advance.
7. Limitation of liability
To the extent permitted by law, the service is provided "as is". We are not liable for any indirect or consequential loss, loss of profit or business, or for any penalty, certificate cost, price adjustment or claim arising from figures used in a CBAM declaration, contract or negotiation. Our total liability for all claims relating to the service in any 12-month period is limited to the fees you paid us in that period. Nothing in these terms limits liability that cannot be limited under Indian law, including for fraud.
8. Suspension and termination
You may stop using the service at any time. We may suspend or close an account that breaches these terms or puts the service or other users at risk, with notice where reasonably possible. Sections 3, 5 and 7 survive termination.
9. Law and disputes
These terms are governed by the laws of India. The courts at Bengaluru, Karnataka have exclusive jurisdiction, subject to any rights a consumer has under the Consumer Protection Act, 2019. Please contact us at contact@fivenine.cloud first; we will try to resolve any complaint within 30 days.
